Is your home scheduled for foreclosure? We have some good news for you. You have several options at your disposal depending on whether or not you wish to keep your home. Keeping your home may be very beneficial to you because it will be difficult for you to get another home in light of the missed mortgage payments on your credit.
As attorneys, we represent YOU and not your lender, another mortgage company, or an investor who wants to buy your property. We are on YOUR side and owe fiduciary duties to you only. You have three options:
LOAN WORKOUTS/MODIFICATIONS
If you have a good reason why you fell behind on your mortgage and sufficient income you may be eligible for a program called a loan workout or loan modification. This means the lender agrees to allow you to make up missed payments over a period of time, suspend payments, or restructure the mortgage in a way you can afford. As your attorneys we will see that the Sheriff's Sale is cancelled or suspended if you qualify for such a program. Be careful. If the lender does not represent in writing that the Sheriff's Sale is canceled or suspended they can still conduct the sale even if you think they are working it out with you.
CHAPTER 13 BANKRUPTCY
When you file for Chapter 13 the Sheriff’s Sale is immediately canceled. You make low monthly payments in a plan which last three to five years. The monthly payment is based on what you can afford. At the end of the payment plan, you will have eliminated all of your bad unsecured debts, like credit cards and medical bills, and you will be current on your mortgage and any car loan.
CHAPTER 7 BANKRUPTCY
However, if you do not wish to retain your home and wish to get a fresh start, we can help you with Chapter 7 Bankruptcy. We have a very competitive price of $899.00 for the attorney fee and filing fee on most cases. With Chapter 7, you make no more payments, owe no debt, and can live in your home payment free for six months after the sheriff sale. Most other debts are gone in Chapter 7.
